These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our other policies referenced here (including our Refund Policy and Privacy Policy).
1) Eligibility & Account
You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase, or have a parent/guardian accept these Terms on your behalf.
If you create an account, you are responsible for maintaining its confidentiality and for all activities under it. Notify us of any unauthorized use promptly.
2) Orders, Acceptance & Availability
Your order is an offer to buy; we may accept or decline any order at our discretion (e.g., for suspected fraud, pricing/stock errors, restricted shipping destinations).
If we cannot fulfill your order after payment, we will cancel and refund the relevant amount to your original payment method.
We reserve the right to limit quantities per order, per person, or per household.
3) Pricing, Taxes & Promotions
Prices are listed in USD and may change without notice.
Taxes, duties, and import fees (where applicable) are your responsibility unless otherwise stated.
Promotional codes/discounts are single‑use, non‑transferable, subject to stated terms, and may be withdrawn at any time.
4) Product Information & Customization
We specialize in canvas artwork, including custom/personalized prints (e.g., your uploaded photos, custom sizes, text, or colors).
Color & crop variance. Due to device displays, materials, and aspect ratios, minor color, brightness, and cropping differences may occur; these are not defects.
Tolerances. Small variances in size, frame alignment, stretch tension, and wrap depth may occur within standard manufacturing tolerances.
We may contact you if your file’s resolution or aspect ratio risks poor results; by proceeding, you accept the output quality inherent in your source file.
5) Your Content (Uploads) & License
If you upload, submit, or otherwise provide images, text, or other content (“User Content”) to produce custom products, you:
Represent & warrant that you own the content or have all necessary rights, licenses, and consents (including model/property releases where applicable) to use it for printing and for us to manufacture the product;
Grant SI ART AVENUE Inc. a non‑exclusive, worldwide, royalty‑free license to reproduce, print, display, and otherwise use the User Content solely to fulfill your order, provide support, and maintain quality records;
Agree not to upload content that is illegal, infringing, hateful, harassing, pornographic, or otherwise violates these Terms or third‑party rights;
Indemnify us for claims arising from your User Content (see Section 13).
We may decline or cancel any order that appears to infringe third‑party rights or violate applicable law.
6) Shipping, Delivery & Risk of Loss
We ship to the address you provide. Verify all details before checkout.
Delivery dates are estimates and may be affected by carrier delays or events beyond our control.
Risk of loss passes upon delivery to the address you provided (or, to the extent permitted by law, upon transfer of the goods to the carrier).
Packages returned to us due to incorrect address or unclaimed deliveries may be reshipped at your expense or refunded minus original shipping (see Refund Policy).
7) Returns, Refunds & Exchanges (Summary)
Please review our Refund Policy for full terms. Key points:
30‑day return window from the delivery date.
For returns not caused by our error or a confirmed defect, return shipping is paid by the customer.
Custom/personalized items are non‑returnable except for verified manufacturing defects or our fulfillment error.
Original shipping fees are non‑refundable, except where required by law or if the return is due to our error.
8) Cancellations
Standard items: you may cancel before shipment.
Custom/personalized items: you may cancel before production starts. After production begins, cancellation isn’t possible.
9) International Customers
You are responsible for customs clearance, duties, taxes, and brokerage fees. Mark return shipments as “Returned goods” to avoid duplicate customs charges.
Consumers in the EU/EEA: Distance‑selling rules include a 14‑day withdrawal period; however, goods made to your specifications or clearly personalized are exempt from withdrawal (see “Legal Notice” below).
10) Intellectual Property (Store Content)
The Services, including site design, graphics, product photography, and trademarks, are owned by SI ART AVENUE Inc. or our licensors and protected by IP laws.
You may not copy, distribute, modify, or create derivative works from our content without prior written permiss
